The Statesman Pine Ridge Mountain Resort Partnership (“the Partnership”), Statesman Developments (B.C.) Ltd. (“SDL”), Metro Recreation Properties Ltd. (“MRPL”), Garth Mann (“G. Mann”), and Jeff Garth Mann (“J. Mann”), contrary to section 14(1) of the Homeowner Protection Act (the “Act”), conducted the business of a residential builder without a valid BC Housing (“BCH”) Residential Builder Licence between the period of, or about, October 31, 2024, and February 7, 2025, with respect to six new homes in Invermere, BC (collectively, the “New Homes”). On February 12, 2025, BCH issued Compliance Order 25-0006 (the “CO”) to the Partnership, SDL, MRPL, G. Mann, and J. Mann directing that the Partnership, SDL, MRPL, G. Mann and J. Mann:
- immediately cease carrying on the business of a residential builder as defined in the Act;
- complete a new Residential Builder Licence Application and successfully become a Licensed Residential Builder (“LRB”) pursuant to section 14(1) of the Act; and
- Cease the above-noted activities until such time as the Partnership becomes a LRB pursuant to section 14(1) of the Act.
The Partnership, SDL, MRPL, G. Mann, and J. Mann were ordered to comply with Compliance Order 25-0006 by March 21, 2025.
